1. What PostAgent Does

PostAgent is an autonomous posting service. After you set up an agent (by answering questions about yourself, optionally providing material such as documents or links, and connecting one or more social media accounts), the service uses artificial intelligence to write posts in your voice and publishes them to your connected accounts on the schedule you choose, without asking you to approve each post.

You can pause an agent, change its instructions, remove queued posts, disconnect accounts, or delete the agent at any time from your dashboard.

2. Your Account

• You must be at least 18 years old and able to enter a binding contract.
• You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.
• One person or business per account. If you set up agents on behalf of a client (for example as an agency), you represent that you have the client's authorization to publish on their accounts.

3. Connected Social Accounts

By connecting a social media account, you authorize PostAgent to publish content to that account on your behalf, using the access the platform grants through its official authorization flow. You are responsible for complying with each platform's terms of use. Platforms may revoke access, change their rules, or limit automated publishing; we are not responsible for any resulting interruption, and we will tell you when a connection needs attention.

4. Your Content and Published Posts

You own what you give us and what we publish for you. You retain all rights to the material you provide (answers, documents, links, writing samples) and to the posts generated and published under your name. You grant us a limited license to store, process, and use that material solely to operate the service for you.

You are responsible for published posts. Because the service publishes autonomously, you agree that posts published to your accounts are your statements. AI-generated content can be inaccurate, incomplete, or state things you would not say. We work to keep drafts grounded in what you have told us, and we flag claims we cannot verify, but we cannot guarantee accuracy. Review your published posts regularly, keep your agent's instructions current, and pause the agent if you do not want it to publish.

You must have the right to use any material you provide. Do not upload content you do not own or are not permitted to use, and do not provide confidential information about others (for example client or patient details) that you are not allowed to publish.

5. Acceptable Use

You agree not to use PostAgent to:

• Publish content that is unlawful, defamatory, harassing, hateful, deceptive, or that infringes anyone's rights
• Impersonate another person or misrepresent your affiliation with any person or organization
• Publish spam, engage in coordinated inauthentic behavior, or violate a platform's rules on automation
• Attempt to access other users' accounts or data, or to interfere with the service's operation or security
• Resell or sublicense the service except as expressly agreed with us in writing

We may suspend or terminate accounts that violate these rules.

6. Trial, Subscription, and Billing

• Free trial. New accounts receive a 7-day trial that does not require a payment method. When the trial ends, agents stop publishing until you subscribe.
• Subscription. The service is offered as a monthly subscription at the price shown on our pricing page at the time you subscribe. Payments are processed by Stripe; we do not store your full card details.
• Renewal. Subscriptions renew automatically each month until cancelled.
• Cancellation. You can cancel at any time from the billing portal in your account. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Refunds. Fees are non-refundable and we do not prorate partial months, except where required by law or where we choose to at our discretion.
• Price changes. We may change prices with at least 30 days' notice by email. Changes apply from your next renewal after the notice period.
• Usage. AI generation and publishing costs are included in your subscription. We may set reasonable limits on posting volume to keep the service reliable for everyone.

7. Our Service and Third Parties

PostAgent relies on third-party providers, including AI model providers, a social media publishing provider, cloud hosting, and payment processing (listed in our Privacy Policy). We may change providers at any time. We aim for continuous operation but do not guarantee that the service will be uninterrupted, error-free, or that every scheduled post will publish; when a post fails we retry and notify you where appropriate.

8. Intellectual Property

The PostAgent service, software, design, and branding are owned by The Post Agent LLC and protected by intellectual property laws. These Terms do not grant you any rights in the service other than the right to use it as described here. Feedback you give us may be used to improve the service without obligation to you.

9. Termination

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service (with reasonable notice where possible). On termination, your agents stop publishing and we delete your data as described in the Privacy Policy. Posts already published to your social accounts remain there unless you remove them; we do not delete content from third-party platforms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR AUDIENCE, ENGAGEMENT, OR BUSINESS RESULT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE POST AGENT LLC AND ITS OWNERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, REPUTATION, OR DATA, ARISING FROM YOUR USE OF THE SERVICE OR FROM CONTENT PUBLISHED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to defend and hold harmless The Post Agent LLC from claims, damages, and expenses (including reasonable legal fees) arising from content you provide, posts published to your accounts, your use of the service, or your violation of these Terms or of any third-party rights or platform rules.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and give us 30 days to try to resolve the issue informally.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above and notify you by email or in-app notice for material changes. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
